of the commissioner's office. at the heart of the decision is the collective bargaining agreement. the judge is saying that the nfl beat up the players so much in the cba, it's unfair. and on top of this, he's saying the commissioner overstepped his bounds with regards to the penalty. and now it's written in the cba the commissioner has the power to levy any penalty on a personal conduct issue such as steroids but he uses that wide reaching power in which was determined to be an equipment issue. the judge tried to get both sides agree instead of taking the collective bargaining agreement to task but ultimately he was forced to release the ruling and in it, he broke down every overreach from lack of evidence to the lack of notice to the fact that the commissioner appointed himself as the appeals office. er. >> there should be some accountability. >> i feel like the nfl

overstepped in the first place. at the same time, he should have stepped up and taken it. >> if he cheat, he should have been penalized but i didn't see the evidence for it. i'm from new england. >> reporter: this is the same position the nfl was in back in 2004 when the nfl was beat in an age discrimination case. the nfl appealed that and won. and now the nfl has to decide if they want to appeal the ruling or take this defeat, if you will. >> yeah, they may be at this stage of the game, like, we have gone after the player of the league long enough, we can't win. and it sounds as though the ted wells report not as impartial. >> at least the judge thought so. and what does this do for player accountability going forward? >> reporter: well, the cba still that has power and the commissioner has the power to make any ruling he wants. i think they're going to take a

little bit more time in levying penalties against play freers now on. >> thank you. now to a -- players from now on. >> thank you. and now a drunk driver leading officers through two towns. we have muggy side information. -- we have new information. >> reporter: the suspect tried to outsmart police, leaving a trail of destruction behind him but the fun the law end -- but his run if the law ended right here. now he is in police custody after a overnight chase spanning two town, seven miles between. >> either he was stoned or drunk, i have no idea but he was running hard. >> reporter: one of the many victims in the ordeal that police say began with a three- car crash before midnight on exit 62. the 26-year-old allegedly drunk, crashed his vehicle into two other cars and then took off running from the scene. the man started chasing him

across the service road and got hit himself by a scrap injured. and they say he made his way here to the lot of pride sullivans and chemicals where he allegedly jumped the fence, employed through the gate and kept going. you can see part of the broken fence. one company manager tells me because they have this security fence, they often lead their trucks with the keys still many the ignition. making it easy for the suspect to hop in and take off. >> still a tractor-trailer and then try to the steal one of my cars so he was running hard. >> reporter: seven miles to be exact. crashing the tractor-trailer right in front of the used car business. not deterred, he says the suspect didn't stop there. >> he came this way. used his hand and punched the glass. he was looking for keys to steal the car to get out. >> reporter: getting to his office today to find this, hand

print, broken door, a ransacked office. and police able to nab him after he fled the business just a few yards away pgh and he's hurting inspect people. it's not right. >> reporter: police say he got banged up during the chase. he has been released this afternoon from the hospital facing a long list of charges. reporting from long island, cbs 2 news. >> police say the man hit by the van is in the hospital with a serious leg injury. investigators want to know if someone intentionally set a huge fire that destroyed a home this morning. chopper 2 flew over the house as firefighters worked through the thick smoke and flames. five residents were hurt. and we are live with more. >> reporter: well, the street is still closed behind me and you can see the house completely destroyed. the fdny commissioner says no one died but he is calling the fire suspicious. smoke poured from the homes engulfed the street as

firefighters work to put out the morning's massive fire. >> my boyfriend woke up and screamed, fire. and we just threw clothes on. and ran outside and dialed 911. >> reporter: the fire started just after 4:30 this morning at 131-2312 >wood which neighbors say was recently renovated. the flames did spread to the home on the right. people on the block couldn't believe it. >> i heard the noises and i thought, it's raining. but then i looked outside and i saw the flames and i never saw anything like it. >> just a shame to see it burn down like this. it's awful. >> reporter: the fdny commissioner says 170 firefighters spent more than two hours trying to get it under control. >> they arrived in three minutes to a wall of fire. the whole front of the building was in flames. >> reporter: he says the four adults and four children inside got out on their own as did their neighbors. the commissioner believes the fire started at the front of porch.

>> it is certainly suspicious. we do -- we've been told there was a similar fire in the neighborhood. >> reporter: the fdny is looking into that fire in march may be related. late this morning, the nypd arson detectivives looked for clues in the front porch debris. the possibility that someone could have intentionally set the fire has left neighbors shaken. >> horrifying, of course. that somebody could be so vicious. >> reporter: five people who lived in the house including three children suffered minor injuries along with five firefighters. so far, no word on what started this fire. reporting in brooklyn, cbs 2 news. >> all right. thank you. there's another cluster of legionnaires disease in the south bronx. the health department says a fourth resident of the melrose house has contracted the disease and is in the hospital.

the water system at one building tested positive. test in two other buildings came back negative. and results are pending on five more. new video of the alleged groping by a tsa screener at denver's international video. the video led to the firing of two officers. authorities say they manipulated the screening process so that one could fondle male passengers. the tsa believes he groped one passenger during a pat down. and the second would cause them to register a male passenger leading to the pat down. a clerk faces a federal judge for refusing to issue marriage licenses. kim davis maintains the issuing would violate her religious beliefs. the judge will decide whether to punish davis. clerks in 13 other counties are defying the supreme court ruling.

a chaotic scene as hundreds of migrants rush towards trains hoping to make it to germany. and the syrian refugees aren't sure where they'll end up now. we are on one of the trains that left hungry's capitol this morning. >> reporter: as soon as the doors open, migrants by the hundreds went flooding in. word spread fast, pack on to the train in the hope that they were headed to germany, austria, anywhere but here. but nobody was telling them anywhere. one wondered, why let them if not to let them go. >> doesn't it feel like they're tricking you? >> they deferment that's why we're hesitating to the take the train or not. >> reporter: hesitating because the migrants fear that instead of going to other country, they'll be taking to holding camps where they'll be forced to apply for asylum. >> they are prisons more than a camp. >> reporter: after weeks on the road and more than a week stuck

here, the migrants are desperate to board any train that will take them away. >> this is my lucky day. >> reporter: onboard was even more chaotic. the heat and humidity of the packed train was unbearable. families with young children and babies struggled for air. for two hour, they held out hope but police ended up stopping the train in hungry and forcing migrants to be bussed to a processing camp. authorities also halted another train full of refugees. one man pulled his wife and baby on to the tracks with him, screaming in protest. well there's much more ahead on cbs 2 news at noon. look at this close call. those are bricks. crashing down from a building. just missing two people walking by. we'll tell you what happened. and a chance to get up close and personal with the pope. we will meet some new yorkers who were chosen for a special

into a close call for a cup until queens. those are bricks that rained down near with -- for a couple in queens. those are bricks that rained down. it happened on sunday on austin street. the falling bricks just missed the couple by what appeared to be inches. witnesses say a parking attendant at a garage on the top floor accidentally crashed a vehicle into a wall of that building which caused that section of bricks to break loose. well, we are learning more details about the pope's visit the new york. a few lucky people will get to see the pontiff. they have been selected to receive a special blessing. we are live in east harlem with more on this story. >> reporter: we are here outside the church on 106th street where it was just announced that a chosen few will be by the pope's side as he visited east harlem in september. and they could not be more honored. the pope's visit to new york city is sure to be a whirlwind experience with many hoping

just for a chance to see the pope. >> we think this is his most important trip, to be with the immigrants and refugees that catholic charities is privileged to serve. >> reporter: today at the parrish on 106th street, the head of catholic charity announced the selected mothers, and children and others who will receive the blessing. >> i feel excited to meet the pope. >> reporter: martha along with a dozen others will be blessed by pope francis at the school in east harlem on september 5th. >> to give them hope that they mean something, that they're important. so i think that's just, it's really amazing. >> being a muslim, i think this will be a huge experience for me. >> having this be the place where he comes to not only meet the diverse community but also embrace the challenges that exist in communities like ours
